Real Estate Ethics Question?

DR KIA Pissed at the World™ asked:

Ok, so long story short, I submitted an offer on a home 2 weeks ago. The listing agent works for the same broker as my agent. The offer was contingent on the sale of my home, which I have a signed purchase agreement on. It had not been through inspection or appraisal at the time, but the buyer had $40000 down and it EASILY appraised for more than the sale price since then. The listing agent for the home I wanted to buy discouraged the sellers from countering my offer telling them that it would never appraise. (The woman is bitter because my agent got my listing, they do not get along). I was forced to walk away, until the inspection & appraisal was done. Now that its completed, I submitted another offer Sunday & gave them 24 hours to respond. Before they responded, the listing agent showed the house to somebody else, who is now writing an offer for more than the list price to beat my offer.

Do I have any recourse against the agent? We are now dealing directly with the broker, because the agent is out of town. This deal could have been sealed 2 weeks ago, if it weren’t for her actions. And per the agreement I have with this brokerage firm, the entire firm represents me, not just my agent. So she in fact bad mouthed my home, although it is in a round about way, her job to sell.

Also, do I have any recourse against the sellers, if they accept an offer from somebody else that is also contingent on appraisal and inspection?
she actually represents me as well as my listing is with the brokerage firm as a whole, not just my listing agent
well they haven’t accepted anything yet. they are going to possibly get more money, but it’s yet to be seen what the other offer has as contingencies. They may not be approved for enough, they may want 3% cashback, they may not have their home sold…
i’m just asking because they denied me because my home wasn’t sold, and I think if their realtor misinformed them, which she admitted to telling them she was concerned about appraisal, there should be recourse against her, for lying. There was no basis for her concern, my house appraised for OVER 40k over the sale price, and 80k over the loan amount. I might also add, the person giving the other offer is one of HER clients, so she will not have to share the commission with my realtor.
Dude my house is sold NOW…it just wasnt at the time
